1. Scope and Acceptance
These Terms & Conditions apply to online reservations, purchases, payments, delivery, returns, and related services for the Garden Room Series (including the Garden Room 118 and Garden Room 158) offered through roomingarden.com in the United States and Canada.
By placing an order, paying a deposit, making a reservation, or purchasing a Garden Room product, the customer agrees to these Terms & Conditions. If a separate written sales agreement or invoice is issued, that document may include additional project-specific terms.
2. Seller Entity by Customer Location
Garden Room products are sold in the United States and Canada through affiliated companies under the Quantum Modular Home brand. The applicable seller of record depends on the customer’s delivery location and will be identified on the order confirmation, invoice, payment receipt, and/or sales agreement.

Unless otherwise stated in writing, U.S. orders are processed, invoiced, fulfilled, and supported by Quantum Modular Home Ltd., and Canadian orders are processed, invoiced, fulfilled, and supported by Quantum Garden Housing Ltd.
3. Product Information
The Garden Room Series includes compact backyard rooms designed for flexible use, such as a home office, studio, gym, lounge, hobby room, or private retreat. The Garden Room 118 is 118 sq.ft and the Garden Room 158 is 158 sq.ft.
Images, renderings, videos, diagrams, colors, finishes, dimensions, and specifications shown on the website are for marketing and reference purposes only. Actual product appearance, materials, details, color tone, texture, accessories, and configuration may vary depending on production batch, selected options, local requirements, and final order confirmation.
4. Product Price and Shipping Fees
The standard online sales price and standard city shipping estimates are listed above by customer location and currency. Prices are subject to change before an order is confirmed. Once Quantum Modular Home Ltd. or Quantum Garden Housing Ltd. accepts and confirms an order in writing, the confirmed product price applies to that order.
Unless expressly stated otherwise, product prices and standard shipping estimates do not include taxes, duties, customs brokerage, unloading, installation, foundation, site preparation, electrical connection, permits, engineering, HOA approvals, storage, special handling, or third-party service costs.
Shipping fees may vary based on city, distance, access conditions, fuel costs, freight availability, customs requirements, ferry routes, remote locations, rural access, special handling, and final delivery address. Additional charges may apply for remote locations, restricted access, failed delivery, storage, re-delivery, crane/forklift service, unloading support, or customer-caused delays.
5. Taxes, Duties, and Government Charges
All applicable sales tax, state tax, local tax, GST, HST, PST, QST, import duty, customs brokerage, customs clearance, and other government charges are the responsibility of the customer unless otherwise stated in writing. Cross-border orders may involve additional customs-related charges that are not included in the base product price or standard shipping estimate unless expressly confirmed.
6. Online Reservation and Order Process
Customers may reserve or purchase a Garden Room product through roomingarden.com. A typical order process includes:
- Customer submits an online reservation or order request.
- Customer provides contact information and delivery address.
- Customer pays the required deposit, reservation payment, or full payment.
- The applicable seller reviews the order, delivery location, site access, and product availability.
- The applicable seller confirms product details, delivery cost, estimated timeline, and next steps.
- Final payment must be completed before shipment or delivery unless otherwise agreed in writing.
An online payment does not guarantee immediate availability, delivery date, installation date, permit exemption, or final acceptance of the order. The applicable seller reserves the right to reject or cancel an order if delivery location, site access, regulatory conditions, payment status, product availability, or other conditions make the order unsuitable or unavailable.
7. Payment Terms
Payment terms may vary depending on order type. Unless otherwise agreed in writing, the customer must pay the full product price, shipping fee, applicable taxes, and any additional confirmed charges before shipment.
Payment options may include reservation deposit, partial deposit, full online payment, final balance before shipment, Stripe, credit card, bank transfer, or another approved payment method. All payments must clear before production, shipment, or delivery begins. Payment processing fees may be non-refundable.
8. Reservation Deposit
If the customer pays a reservation deposit, the deposit secures the customer’s place in the reservation and review process. It does not guarantee final product availability, fixed delivery date, permit approval, permit exemption, installation availability, final site approval, or final cost for delivery, installation, site work, taxes, or upgrades.
The reservation deposit may be refundable before final order confirmation, subject to the cancellation and refund terms below.
9. Order Confirmation
An order is considered confirmed only after the applicable seller issues a written order confirmation, invoice, sales agreement, or confirmation email that includes the product, price, delivery location, payment status, and estimated delivery terms.
Before order confirmation, the applicable seller may request property address, site photos, access details, intended use, delivery restrictions, local permit or zoning information, foundation information, and installation requirements.
10. Delivery Timeline
Estimated delivery timelines are provided for general planning only and are not guaranteed. Delivery may be affected by production schedule, inventory availability, transportation availability, customs clearance, weather, road conditions, strikes, port delays, government inspection, force majeure events, or customer-caused delays.
The applicable seller is not responsible for indirect losses, lost income, rent, business interruption, project delays, contractor standby fees, or other consequential damages caused by delivery delays.
11. Customer Site Responsibilities
The customer is responsible for ensuring that the delivery site is suitable, accessible, safe, and ready before delivery. Customer responsibilities may include:
- Confirming property access, driveway access, backyard clearance, and overhead clearance.
- Preparing a level and stable foundation or support system.
- Removing obstacles and confirming safe unloading area.
- Confirming utility locations and site conditions.
- Obtaining required permits, HOA approvals, zoning approvals, and utility approvals.
- Ensuring compliance with local rules and restrictions.
If the site is not ready or accessible at the scheduled delivery time, additional fees may apply for failed delivery, waiting time, storage, re-delivery, or rescheduling.
12. Installation
Unless expressly included in the written order confirmation, installation is not included in the standard product price. Installation services, if available, may be provided by the applicable seller, an affiliated installer, local contractor, or third-party service provider. Installation pricing depends on location, foundation, access, site condition, electrical work, selected options, and local requirements.
13. Permits, Zoning, HOA, and Local Regulations
Garden Room products may not require a building permit in some jurisdictions, depending on size, use, location, setbacks, height, foundation, utilities, and local regulations. However, permit and zoning requirements vary across the United States and Canada.
The customer is solely responsible for confirming and complying with all applicable building permits, zoning bylaws, setback requirements, lot coverage limits, height restrictions, HOA rules, utility permits, electrical permits, fire safety requirements, occupancy restrictions, and other local rules.
Neither seller guarantees that the product will be permit-exempt in every location. Use as a sleeping unit, dwelling unit, rental unit, accessory dwelling unit, guest house, or plumbing-connected structure may require additional approvals.
14. Product Use
Garden Room products are intended as flexible backyard rooms for general non-dwelling uses such as office, studio, gym, lounge, or hobby space. Unless specifically approved and permitted by local authorities, the product should not be used as a legal dwelling unit, rental unit, permanent sleeping unit, kitchen-equipped residential unit, plumbing-connected living unit, or any use prohibited by local law, HOA rules, or zoning regulations.
15. Return Policy
Because Garden Room products are large-format building products involving freight, handling, production, inspection, and potential customization, returns are limited. A return may be considered only if all of the following conditions are met:
- The product is unused, uninstalled, unassembled, undamaged, and in original condition.
- The return request is submitted in writing within 7 calendar days after delivery.
- The applicable seller approves the return in writing before the product is shipped back.
- The customer pays all return freight, handling, insurance, packaging, inspection, and related costs.
- The product can be safely returned in a condition suitable for resale.
The applicable seller may refuse returns that are damaged, installed, modified, assembled, used, weather-exposed, missing components, or not in resale condition.
16. Non-Returnable Items
The following items are non-returnable: custom color products, custom configurations, special-order products, installed products, assembled products, products modified by the customer or third parties, products damaged after delivery, products affected by improper storage or exposure, clearance or final sale items, installed electrical/mechanical/accessory items, and products shipped outside the standard service area unless otherwise approved.
17. Return Shipping and Restocking Fee
If a return is approved, the customer is responsible for all return-related costs, including return freight, packaging, loading, unloading, insurance, storage, inspection, repair of damage, missing components, customs, and brokerage fees if applicable.
Approved returns may be subject to a restocking fee of up to 25% of the product price. Original delivery fees, shipping charges, customs fees, taxes, payment processing fees, installation fees, site review fees, and third-party service charges are non-refundable unless required by law.
18. Cancellation Policy
Before Order Confirmation
If the customer cancels before final order confirmation, the reservation deposit may be refundable, less any payment processing fees or administrative costs already incurred.
After Order Confirmation but Before Production or Shipment
If the customer cancels after order confirmation but before production or shipment, the applicable seller may deduct administrative costs, design/review costs, payment processing fees, and any other costs already incurred.
After Production, Customization, Packing, Freight Booking, or Shipment
Orders cannot usually be cancelled once production, customization, packing, freight booking, shipment, or delivery has started. If the applicable seller agrees to cancel at this stage, cancellation fees, freight fees, restocking fees, and other costs may apply.
19. Damage Upon Delivery
The customer or customer’s representative must inspect the product upon delivery. If there is visible damage, the customer must note the damage on the delivery receipt or bill of lading, take clear photos and videos before unloading or unpacking, notify the applicable seller in writing within 48 hours of delivery, and keep all packaging and damaged components for inspection.
Failure to report delivery damage within 48 hours may affect the customer’s ability to make a claim. The applicable seller may choose to repair, replace, provide replacement parts, or assist with a freight claim depending on the nature and cause of the damage.
20. Missing Parts
Any missing parts must be reported in writing within 7 calendar days after delivery. The applicable seller may provide replacement parts after verifying the claim. The customer must provide photos, packing list, delivery documents, and other requested evidence.
21. Warranty
Garden Room products may include a limited product warranty covering certain manufacturing defects. Warranty coverage does not apply to damage or issues caused by improper installation, improper foundation, site movement or settlement, unauthorized modification, misuse, lack of maintenance, extreme weather beyond design limits, flooding, fire, impact damage, improper storage, third-party work, electrical or utility work not performed by qualified professionals, normal wear and tear, color fading, minor surface variation, or cosmetic differences within normal tolerance.
A separate warranty document may be provided and will control warranty coverage if there is any conflict with these Terms.
22. Product Variations and Improvements
Due to manufacturing, material supply, photography, lighting, display settings, and production improvements, product appearance may vary from website images and renderings. The applicable seller may make minor changes to product materials, details, specifications, finishes, or components without prior notice, provided the general function and product type remain substantially similar.
23. Third-Party Services
The applicable seller may refer customers to third-party contractors, installers, electricians, engineers, freight companies, or other service providers. Unless expressly stated in writing, third-party services are independent. The applicable seller is not responsible for third-party workmanship, pricing, scheduling, permits, insurance, licensing, or performance.
24. Online Payments and Security
Online payments may be processed through third-party payment processors such as Stripe or other providers. Neither seller stores full credit card information. Payment processing is subject to the terms and privacy policies of the applicable payment processor.
25. Limitation of Liability
To the maximum extent permitted by law, the applicable seller’s liability is limited to the amount paid by the customer for the product giving rise to the claim. Neither seller is liable for indirect, incidental, special, consequential, or punitive damages, including loss of income, loss of use, project delays, contractor charges, rental costs, business interruption, permit denial, zoning disputes, HOA rejection, or property value changes.
26. Force Majeure
Neither seller is responsible for delay or failure caused by events beyond its reasonable control, including weather, natural disasters, fire, flood, labor disputes, port delays, transportation disruption, material shortage, government action, customs delay, pandemic, war, civil unrest, or supply chain disruption.
27. Website Content
All website content, including images, renderings, text, videos, diagrams, logos, product descriptions, and design materials, belongs to the applicable owner or its licensors and may not be copied, reproduced, modified, distributed, or used without written permission.
28. Privacy
Customer information collected through roomingarden.com is used for order processing, customer communication, delivery coordination, payment processing, marketing, and business operations. Please refer to the Privacy Policy for more information.
29. Governing Law and Customer Rights
For U.S. orders, these Terms & Conditions shall be governed by the laws of the applicable U.S. jurisdiction where Quantum Modular Home Ltd. is registered, unless otherwise required by applicable consumer protection law.
For Canadian orders, these Terms & Conditions shall be governed by the laws of the province where Quantum Garden Housing Ltd. is registered, unless otherwise required by applicable consumer protection law.
Nothing in these Terms & Conditions limits any mandatory consumer rights that may apply in the customer’s state, province, or territory.
